4 Il targeting nello urban battlespace B) Gli scudi umani “volontari” e “involontari” Le valutazioni difformi sugli scudi umani “involontari”: “only individuals acting as a physical obstacle to the military activities of the approaching opposing party, particularly in cases of ground operations in urban environment, can be qualified as taking a direct part in hostilities. In other circumstances, such as air operations or artillery attacks, such individuals do not impair the possibility to target the military objective at issue and do not produce any harm on the attacking forces. Thus, in such cases they would only represent a “legal” obstacle, but would maintain their protection” (ICRC, Interpretative Guidance Direct participation hostilities)

6 L’applicazione del principio di proporzionalità nello urban warfare “The fact that a military objective is located in a populated area means that civilians and civilian objects may legitimately suffer indirectly if those objectives are attacked, subject to the rule of proportionality” (UK Military Manual, 2004) L’ammissibilità di danni collaterali (vedi invece Rapporto Commissione inchiesta su Georgia-Russia) Il problema della cd. “force protection” (Vantaggio militare nell’ottica di israele, 2009: “In addition, it may legitimately include not only the need to neutralise the adversary’s weapons and ammunition and dismantle military or terrorist infrastructure, but also — as a relevant but not overriding consideration — protecting the security of the commander’s own forces”)

7 L’applicazione del principio di proporzionalità nello urban warfare Il crescente rilievo per la non “sostenibilità” di perdite civili, al di là dei limiti giuridici COIN Manual Petraeus 2006: “In COIN environments, the number of civilian lives lost and property destroyed needs to be measured against how much harm the targeted insurgent could do if allowed to escape. If the target in question is relatively inconsequential, then proportionality requires combatants to forego severe action…An air strike can cause collateral damage that turns people against the host- nation (HN) government and provides insurgents with a major propaganda victory”

8 L’applicazione del principio di proporzionalità nello urban warfare Afghanistan: ISAF Tactical Directive McChrystal 2009 “We must avoid the trap of winning tactical victories – but suffering strategic defeats – by causing civilian casualties or excessive damage and thus alienating the people…I expect that leaders at all levels to scrutinize and limit the use of force like close air support against residential compounds and other localitions likely to produce civilian casualties in accordance with this guidance. Commanders must weight the gain of using CAS against the cost of civilian casualties, which in the long run make the mission success more difficult and turn the Afghan people against us…The use of air-to- ground munitions and indirect fires against residential compounds is only authorized under very limited and prescribed conditions (classified)”

9 L’applicazione del principio di proporzionalità nello urban warfare Libia 2011: NATO: “Not one of the targets struck…was approved for attack…if…civilians would be injured or killed by a strike…Rigorous procedures…followed…to ensure that there was a “zero expectation” of death or injury to civilians” L’impatto di questa prescrizione sulla condotta delle operazioni Origine di questo potenziale limite nella ris. 1973. Un principio assoluto? La valenza di questo limite non deve modificare le valutazioni di ius in bello (UN Commission of Inquiry: “The Commission is unable to conclude..whether such a strike within a military compound, is consistent with NATO’s objective to avoid civilian casualties entirely).

10 Il principio di precauzione nello urban warfare Identificazione Mezzi di combattimento. L’impiego di armamento di precisione (es. impiego 100% PGMs nell’operazione Unified Protector con peculiari caratteristiche - 82% da 500 lbs o meno; delayed fusing) I problemi per le unità terrestri (UK Military Manual, “Sometimes, especially during fighting in towns, the tactics employed can make a great difference to the control of incidental damage. Artillery fire can cause a lot of incidental damage without any appreciable military advantage”). Armi di dubbia utilizzabilità in contesto urbano: cluster munitions e armi incendiarie (art. 2 III Protocollo CCW) e al fosforo bianco

11 Fosforo bianco Impiegato nei traccianti: escluso da proibizione III protocollo e non rientra neanche fra le armi chimiche Usato come arma incendiaria: Non lecito se: a) usato contro civili; b) se usato, da aeromobile, per attaccare obiettivi (beni) militari situati in zona dove vi è “concentrazione di civili” (città, colonne e campi rifugiati, ecc.) ; c) attacco da terra contro obiettivo militare locato in concentrazione di civili che non è chiaramente separato da questa “concentrazione” e necessità di adottate tutte le misure di precauzione per minimizzare gli effetti (es. eventualmente lecito contro porti, depositi materiali bellici, riserve petrolifere, bunkers, se popolazione ha lasciato villaggi) Le contestazioni del Rapporto Goldstone su mancato rispetto principi di precauzione per uso fosforo bianco in aree abitate e presso centri sanitari Per UK Military Manual interdetto uso diretto contro combattenti avversari, ammesso solo contro obiettivi mil.

12 Il principio di precauzione nello urban warfare Il problema della Force protection nell’ambito dell’art.57.2,lett.a (ii) “Take all feasible precautions in the choice of means and methods of attack with a view to avoiding, and in any event to minimizing, incidental loss of civilian life…”. UK: “the risks to his own troops of the various options open to him”; COIN Manual: “Combat, including counterinsurgency and other forms of unconventional warfare, often obligates Soldiers and Marines to accept some risk to minimize harm to non-combatants” Avvertimento Obblighi di precauzione della parte attaccata

13 Il “divieto” di urban warfare La risoluzione 1973 e la possibilità di utilizzare la forza “to protect civilians and civilian populated areas”. L’interpretazione data al mandato. Gli attacchi contro gli assets militari delle forze lealiste. L’utilizzo di un “three-pronged test” includente ris. 1973. Il “criterio geografico” utilizzato nella campagna aerea: Gli attacchi contro gli assets militari localizzati presso aree urbane (es. “14 tanks destroyed earlier this morning in the outskirts of Misratah”; “Most of the tanks destroyed were being deployed around Ajdabiya where Gaddafi forces fell back from their positions in the city after Sunday’s air strikes”; “11 tanks destroyed today as they approached Ajdabiya”; “Most of our…dynamic strikes are done when we see the movement of military material going towards a population centre”) Gli altri criteri seguiti: “previous use” e uso potenziale per attacchi indiscriminati
