In other circumstances, such as air operations or artillery attacks, such individuals do not impair the possibility to target the military objective at issue and do not produce any harm on the attacking forces. Thus, in such cases they would only represent a “legal” obstacle, but would maintain their protection” (ICRC, Interpretative Guidance Direct participation hostilities)

If the target in question is relatively inconsequential, then proportionality requires combatants to forego severe action…An air strike can cause collateral damage that turns people against the host- nation (HN) government and provides insurgents with a major propaganda victory”

L’applicazione del principio di proporzionalità nello urban warfare Afghanistan: ISAF Tactical Directive McChrystal 2009 “We must avoid the trap of winning tactical victories – but suffering strategic defeats – by causing civilian casualties or excessive damage and thus alienating the people…I expect that leaders at all levels to scrutinize and limit the use of force like close air support against residential compounds and other localitions likely to produce civilian casualties in accordance with this guidance. Commanders must weight the gain of using CAS against the cost of civilian casualties, which in the long run make the mission success more difficult and turn the Afghan people against us…The use of air-to- ground munitions and indirect fires against residential compounds is only authorized under very limited and prescribed conditions (classified)”

La valenza di questo limite non deve modificare le valutazioni di ius in bello (UN Commission of Inquiry: “The Commission is unable to conclude..whether such a strike within a military compound, is consistent with NATO’s objective to avoid civilian casualties entirely).

Il principio di precauzione nello urban warfare Identificazione Mezzi di combattimento. L’impiego di armamento di precisione (es. impiego 100% PGMs nell’operazione Unified Protector con peculiari caratteristiche - 82% da 500 lbs o meno; delayed fusing) I problemi per le unità terrestri (UK Military Manual, “Sometimes, especially during fighting in towns, the tactics employed can make a great difference to the control of incidental damage. Artillery fire can cause a lot of incidental damage without any appreciable military advantage”). Armi di dubbia utilizzabilità in contesto urbano: cluster munitions e armi incendiarie (art. 2 III Protocollo CCW) e al fosforo bianco

Fosforo bianco Impiegato nei traccianti: escluso da proibizione III protocollo e non rientra neanche fra le armi chimiche Usato come arma incendiaria: Non lecito se: a) usato contro civili; b) se usato, da aeromobile, per attaccare obiettivi (beni) militari situati in zona dove vi è “concentrazione di civili” (città, colonne e campi rifugiati, ecc.) ; c) attacco da terra contro obiettivo militare locato in concentrazione di civili che non è chiaramente separato da questa “concentrazione” e necessità di adottate tutte le misure di precauzione per minimizzare gli effetti (es. eventualmente lecito contro porti, depositi materiali bellici, riserve petrolifere, bunkers, se popolazione ha lasciato villaggi) Le contestazioni del Rapporto Goldstone su mancato rispetto principi di precauzione per uso fosforo bianco in aree abitate e presso centri sanitari Per UK Military Manual interdetto uso diretto contro combattenti avversari, ammesso solo contro obiettivi mil.
