6 LADI – Federal law on the insurance against unemployment The Swiss unemployment system works according to an insurance logic. It is very structured and constrained, both from rights and from duties point of view. Objectives of the agreement between Confederation and local administrations (Cantoni) for the appliance of the law:  Rapidly re-insert  Reduce long-term unemployment  Limit the number of people who expire their right to benefits  Limit the number of people who register back into the insurance 6

7 LADI – Federal law on the insurance against unemployment « Passive» measures The law sets the right to receive unemployment benefits for job seekers, who fulfil all the seven legal requirements. 1. Notion of unemployement 2. The job loss must be accountable 3. Be resident in Switzerland 4. Age limits (17-64/65) 5. Having paid the insurance for the settled period, or be exonerated for settled reasons 6. Be fit and available for employment 7. Strictly respect regulations on control. 7

9 LADI – Federal law on the insurance against unemployment Exemption from duty of contribution: 1. Education and training, inability to work, stay in prison 2. Separation and divorce, end of invalidity benefits 3. Return from residence abroad (outside UE) Equivalent periods of contribution 1. Employment from end of education to 17 years of age 2. Military service 3. Maternity insurance (14-16 weeks) 4. Valid employment contract but no salary because of sickness or accident 9

10 LADI – Federal law on the insurance against unemployment Quota of contribution: 2.2%, 50/50 shared with employer, up to Frs.10’500/month. Then solidarity contribution of 1% on salaries up to Frs 26’250/month. Insured income: global amount calculated in accordance to law on social security, including 13 th month of salary, bonus, night work extras, shifts extras, ecc. Minimum is Frs 500/month, under which there is no right. Period of calculation: average income of last 6 months, or 12 months if more convenient for the beneficiary. 10

L’80% to people who have support obligations, or whose insured income is < Frs 3’797/month or has invalidity rent of 40% min. Exemple of daily indemnity: Insured income / 21.7 (days/month) x benefit quota Frs 4’500 : 21.7 x 70%=145.16 145.16 x 21 (working days February) = Frs 3’048 NB unemployment benefits are subject to social contributions and are taxable 12

13 LADI – Federal law on the insurance against unemployment Actors in the application of the law UMA –Active Labor Market Measures Office Regional employment offices (URC): consultants help insured people to find an adequate job asap They provide guidance, control and the assignement of Active Measures Unemployment Cash-desks (trade union): they set and calculate right to indemnities and provide for monthly withdraws «Cantonal» Legal service: grants for equal application and decides in case of doubts or conflicts. 13

14 Beneficiary’s duties 1. Reduce the loss 2. Provide for proofs of job search personal efforts 3. Attend guidance and control meetings with Personal Consultant at URC 4. Obligation to inform punctually (monthly «report») In brief: the insured person is obliged to proof his/her efforts to re-insert according to the strategy decided with the PC and accept Active Measures he/she is assigned by PC 14 LADI – Federal law on the insurance against unemployment

16 LADI e LMPs – Role of unemployment Personal Consultant and re-insertion strategy The PC is in charge for the setting and managing of a focused, personalised strategy aiming at rapid and durable re-insertion of every insured job seeker assigned to his/her «care» He/she is provided with strict indications, codified procedures and a guide to Active Measures. He/she still keeps a margin of discretionary power, going less and less in the years. During the first interview with the job seeker (2h), the PC makes a «coding» of the beneficiary, i.e. he/she assigns him/her to a “group”, according to specific personal and professional features. The coding allows the PC to instantly visualise Active Measures meant for that type of job seeker. 16

17 ALMPs – Active labor market policies and measures Aim of AM: promote rapid and lasting re-integration of insured people, whose placement in the job market is difficult, due to job market-related reasons. How? Improving their “suitability” to placement Promoting professional qualification according to labor market needs Decreasing the risk of long-term unemployment Supporting acquisition of professional experiences 17
